August 15, 2011
Land Division Application of T8-0355, section 17

7:00 pm
Members present: Commissioner William Butzlaff, Commissioner Victoria Heideman, Commission Tom Schoofs, Chair Daniel H. Schmidt, Supervisor Michael Otten, Supervisor Scott Wollner, Clerk Nancy Boden, and 11 concerned citizens
• Chair Daniel H. Schmidt opened the public hearing at 7:02 pm
• Due to a conflict of interest Chair Schmidt moved to appoint Supervisor Wollner as acting-chair for the public hearing, seconded by Supervisor Otten, motion carried by voice vote 3-0. Chair Schmidt removed himself from the table to sit in the audience.

Was concerned about the qualifications of the division; the need for soil borings, why?
Gary Richtmyre 8771 Highland Drive
Asked how the 40 acres was being divided and what will happen to the other 55 acres
Was shown a copy of the proposed plat of survey and the Schmidt’s stated the remaining 55 acres would be kept in farmland
Dave Dorn 4280 Ridge Road
Suggested that the CSM’s and/or Plat of Surveys should be posted for the public to see
Copies are available from the clerk’s office upon request
• Moved by Otten/Schoofs to close the public hearing at 7:07pm, motion carried by voice vote 5-0

Town Board Meeting

Present: Chairperson Daniel H. Schmidt, Supervisor Michael Otten, Supervisor Scott Wollner, Treasurer Daniel Stoffel, Clerk Nancy Boden, and 12 concerned citizens
Absent: none
• Chairperson Schmidt called the town board meeting to order at 7:40pm
• The Meeting was properly posted and noticed
Notices Posted: Posting boards at the Town of Kewaskum Community Center, at the Van Vechtin and Buffalo Cemeteries
Notices: Kewaskum Statesman, West Bend Daily News, Radio Stations WBKV & WTKM
• Pledge of Allegiance was recited
• Roll Call was taken
• Moved by Wollner/Schmidt to approve the town board minutes from July 19, 2011 as printed, motion carried by voice vote 3-0
Public Comment
Dave Dorn 4280 Ridge Road
Asked for clarification on which culvert issue on Ridge was being discussed
• Due to a conflict of interest Chair Schmidt moved to appoint Supervisor Wollner as acting-chair for the Schmidt Land Division agenda item, seconded by Supervisor Otten, motion carried by voice vote 3-0. Chair Schmidt removed himself from the table to sit in the audience.
Land Division of T8-0355, Iona (Schmidt) Parrish
Board members discussed the land division
• Moved by Wollner/Otten to conditionally approve the land division base on receiving approval of a driveway placement by the town’s engineer and having that location placed on the plat of survey, motion carried by voice vote 2-0
Chair Schmidt returned to the table to resume his duties as chair
Operator Licenses
• Moved by Schmidt/Otten to approve an operator license for Heather Rose Zuehlke and Sara Taylor, motion carried by voice vote 3-0.
Pre-Buy Propane
Supervisor Otten suggested that the town only pre-buy a portion of the needed amount, he feels that the price of propane will drop.
• Moved by Schmidt/Wollner to pre-buy 1550 gallons of propane from Strobel Propane Gas Company at a cost of $2.03 per gallon, motion carried by voice vote 3-0
This item will be placed on the September agenda for review
Easement Agreement between the Town of Kewaskum and the Village of Kewaskum
The chair gave a history of this issue, the board discussed that the village board approved the reimbursement of $583 at their March 7th village board meeting. Payment has yet to be received.
• Moved by Schmidt/Wollner to have the chair talk to Mr. Heiser and Mr. Pesch with the signed easement documentation in hand, the chair will ask about the payment of $583 that the village agreed to pay, the easement document will be left with Mr. Heiser and Mr. Pesch for Village Board approval and signature, motion carried by voice vote 3-0
Grievance Procedure
The board members reviewed the sample grievance procedure the was supplied by the Wisconsin Town’s Association. The chair will see if a neighboring municipality’s chair would be our “hearing officer” and our chair would be theirs.

Amending Chapter 20 – requiring a permit for utilities performing work in the right-of-way
Chair Schmidt stated that he would like a permit that utilities would fill out explaining the work that will be done in the town’s right-of-way and when it will be completed. Would like the zoning administrator to give his thoughts on this subject

Amending Chapter 9 – Conceal Carry Law
When the conceal carry law goes into effect on November 1, 2011 the town’s current code section 9.02 would be no longer valid. Section 9.01 will need to be checked to insure all the statue numbers are accurate. The clerk will spend some time doing this.

Recycling Grants and General Procedures
Board members discussed the possibility of working with neighboring municipalities in order to get the 2nd grant option.
• Moved by Schmidt/Otten to not apply for the 2nd grant option but leave the door open in case approached by another municipality, motion carried by voice vote 3-0
REPORTS
Road Maintenance by Chairperson Schmidt
• Shouldering was done on Badger, Kettleview, Prospect, E. Moraine; finished on August 7th
• Crack filling on Kettle Moraine, between Hwy H and Ridge was done by Fahrner on July 9th
• Crack filling was done on Badger Road and Highland by Cross Plains on August 11th
• Wedging and patching was done by Scott Construction on Badger, Prospect, E. Moraine on August 10th and 11th
• Seal Coating to be done by Fahrner and Scott Construction within the next 2 weeks, weather permitting on Kettle Moraine, Forestview, Badger, E. Moraine, Prospect
• Will be getting 10 to 20ton of recycled asphalt for shouldering some of the hills and curved throughout the township that have erosion issues.
Community Center by Chairperson Schmidt
Chair Schmidt reported that all updates to the community center are completed. The refrigerator is not working. Mike Otten will get a new one. Supervisor Wollner stated that the toilet should have iron out tablets in the tank every month to help with the lime buildup due to the fact that the water softener is not hooked up.
Ridge Road, Berg Culvert Issues by Supervisor Wollner
Supervisor Wollner stated that he spoke to all parties to get the issues resolved. Mr. Berg will be hiring a different firm to complete the restoration properly. The previously hired excavator stated that he would pay. Update in September
Farmland Preservation Advisory Meeting by Supervisor Otten
Supervisor Otten reported that the following municipalities approved the farmland preservation maps: Town of Barton, Town of Jackson, Town of Germantown, Town of Wayne, Town of Hartford, and Village of Richfield. The next meeting will be August 25th, Supervisor Otten will attend.
