Town Board Meeting
May 16, 2011

Present: Chairperson Daniel H. Schmidt, Supervisor Michael Otten, Supervisor Scott Wollner, Treasurer Daniel Stoffel, Clerk Nancy Boden, and 6 concerned citizens.
Absent: none
? Chairperson Schmidt called the town board meeting to order at 7:00pm

 Notices: Kewaskum Statesman, West Bend Daily News, Radio Stations WBKV & WTKM
? Pledge of Allegiance was recited
? Roll Call was taken
? Moved by Schmidt/Wollner to approve the town board minutes from April 11th, 18th, 20th, and 26th as printed with an amendment to April 26th minutes line 6, chair?s name needs to be corrected, motion carried by voice vote 3-0
Public Comment
David Dorn 4280 Ridge Road
Asked to speak when agenda item #8 is discussed
Mileage Reimbursement Policy
Chair Schmidt stated that when an employee uses his/her personal vehicle for town business they should be reimbursed for those miles driven. Currently employees are reimbursed at the federal rate.
? Move by Schmidt/Otten to add a paragraph in the employee handbook outlining mileage reimbursement and bring that DRAFT back to the town board for approval at its next regular meeting, motion carried by voice vote 3-0.
2011 Spring Road Tour Results
? The intersection of Ridge Road and Kettleview Drive has a dranage issue. Water runs across the roadway during heavy rains and spring thaw due to a crushed culvert and a ditch that is silted in.
Mr. Dave Dorn spoke and gave a history of the intersection and asked the board to install a culvert by the stop sign to keep all the water flowing down the same side of the roadway and out of his field.
Chair Schmidt stated that the public works department will try the following first:
1. Clean up the culvert
2. Clean out the ditch
3. Have the land owner remove his pine trees from the road right-of-way.
He feels that this may fix the problem, if not the intersection will be looked at again for more work.
? Bump signs will be installed on Ridge Road before the culvert just west of the Dorn property.
? Turn-arounds in the town need to be looked at.
On County Line Road west of N. Mill Road the town must determine if its owns the right of way
? Property owners throughout the town with driveways that need to be cleared due to height and width issues with emergency equipment will be contacted
? The intersection of County Line/Kettle Moraine and County Line/Townline need to have the vision triangles cleared.
? Roads needs to be seal coated and crack filled
? Ridge road needs culvert repairs
? Ditching and Shouldering needs to be done
2011 Crack Filling
The board discussed the proposal received from Crack Filling Service, Corp. Chair Schmidt will contact Scott Herrling from Crack Filling Service to discuss some additional roads and get some clarification on other roads. He will bring his finding to the June town board meeting.
Ditching on County Line Road, 50/50 cost split with Town of Auburn
Chair Schmidt spoke with the chair of the Town of Auburn about ditching County Line Road from Kettle Moraine Drive to Forestview Road and they decided to wait on this project. Ditching will be done by town public works on County Line Lane at Hwy S to try to unplug the culvert. Workers time will be documented and Town of Auburn will pay half.
Unloading Construction Equipment on Town Roads
The board reviewed the current construction standards
? Moved by Wollner/Schmidt to amendment letter ?o? to read as follows ?New construction/addition projects must submit photos of roadway 500 feet each way from driveway location, photos must be submitted before permit is issued.?, motion carried by voice vote 3-0.
Recycling Hours
? Moved by Schmidt/Otten to change the recycling hours to Wednesdays 5:30pm to 7:30pm from May 15th to September 15th, Saturdays 8:00am to noon, these hours will start June 15th, motion carried by voice vote 3-0.
Volunteer Workers Agreement
Board members reviewed the current volunteer workers agreement.
? Moved by Schmidt/Wollner to amend #1 to read as follows: ?Volunteer Worker will not perform any work relating to cutting up or removing any scrap wood from the town road shoulder unless property signage is used, signs provided by the Town?, this agreement will be reviewed by the board again at the June meeting, motion carried by voice vote 3-0.
PASER Rating Process
The town engineer rated the roads this year, next year the board will rate the roads during its spring road tour.
Fee for lot lines redrawn on CSM
? Moved by Schmidt/Wollner to have a land owner who wished to have their lot lines redrawn have a CSM drawn up and reviewed by the Zoning Administrator, if any issues arise it will be reviewed by the Town?s Engineer. The land owner must come before the Plan Commission to get approval to file the CSM with Washington County. The cost of profession fees(zoning admin, engineer) will be charged back to the land owner and the cost of the plan commission reviewing it will be prorated based on the number of agenda items on the plan commission agenda, motion carried by voice vote 3-0.

The Town Board of the Town of Kewaskum, Washington County, Wisconsin, by this resolution, adopted by a majority of the town board on a roll call vote with a quorum present and voting and property notice having been given, resolves and orders as follows:

The following financial institution is designated as the public depository for the Town of Kewaskum:

The town clerk should properly post or publish this resolution as required under s. 60.80, Wis. stats.

Resolution No. 2011-04, policies for public records

RESOLUTION NO. 2011-04
A Resolution setting policies for the access, copying and sale of public records for the Town of Kewaskum


Whereas, the State law pertaining to public documents is found in Sections 19.21 through 19.39 of Wisconsin Statutes, and

Whereas, the law requires public accessibility to public documents in a reasonable manner and time span, and

Whereas, the Town of Kewaskum clerk is the official custodian of all public documents of the Town;

Now it is resolved, that the following rules are hereby adopted pertaining to the protection, accessibility, copying and sale of public documents:

1. Any person may request a public record, including written documents and tape recordings, which shall be provided, except for those determined to be of a confidential nature defined as those exempt by Federal or State law or by the courts, or if the harm to the public interest from disclosure outweighs the public interest in inspection.
2. The Town will provide access during regular office hours.
3. A request for records may be oral or in writing but before a legal action to enforce the request is begun it must be put in writing.
4. A request for a record or information will be considered sufficient if it is reasonably described, the subject matter is reasonably limited, and the length of time represented by the record is reasonable.
5. In general, employment records including applicant records, computer programs, personal property tax returns, and law enforcement records will not be provided to the public.
6. The charge for a copy of each single page of records will be 25 cents; the copying will be done by the custodian of the records. If the charge will exceed $5 the clerk may request payment in advance.
7. The charge for each CD of an audio recording of proceedings shall be $25.
8. The cost of the clerk?s time to fulfill open records requests is $20 per hour.
9. The clerk will use his/her best efforts to provide requested documents in a timely and prompt manner.
10. To assure clarity and understanding, a request for more than three documents shall be in writing if requested by the clerk.
11. No person, other than the clerk or his/her appointed designee, shall have access to the files and records of the Town unless authorized by the clerk.
